Vexam Terms of Use

1. Agreement

By installing or using Vexam you agree to these terms. If you do not agree, do not use the app.

2. What Vexam is, and is not

Vexam is a study aid for professional examinations. It is not professional advice of any kind. Where our content covers a clinical subject it is not medical advice or clinical guidance, and must never be used to make a decision about the care of a real person.

We are not affiliated with, endorsed by, or connected to any examination board or awarding body. Examination names and marks referred to in the app or on our site, including NCLEX-RN®, a registered trademark of the National Council of State Boards of Nursing, Inc., belong to their respective owners and are used only to say which examination our material prepares you for. Our questions are written by us against published sources and are not real examination questions.

3. No promise that you will pass

We do not guarantee any examination outcome. Passing depends on your preparation, your knowledge and the examination itself. Any statement we make about our content describes our content, never your result.

4. Accuracy, and how to tell us we are wrong

Every question names the source it rests on so you can check it. We work hard to be right and we will sometimes be wrong. Report any question from the flag icon in the app. Reports about a wrong answer go to the top of the queue, and we can withdraw a question from everyone without waiting for an app update.

5. Subscriptions and payment

Subscriptions are sold and billed by Apple or Google, not by us. They renew automatically until you cancel, and you cancel through your app store account settings, not through us. We cannot charge you, and we cannot refund you: only the store can.

Prices are shown in the app before you buy, in your own currency, and they come from the App Store rather than from us. A free tier is always available, including one question every day and a number of practice questions daily.

If we offer a free trial, the length is shown on the purchase screen. A trial converts to a paid subscription when it ends unless you cancel before then, which you can do at any time in your App Store account settings.

What "unlimited" covers. A subscription removes the daily cap on practice questions and the monthly cap on mock exams; those are uncapped. Two features are metered because each use calls a paid service on our side, and their allowances are shown in the app on the screen you subscribe from: follow-up questions to the tutor and scanning a question from a book or screen to have it explained. We may change these allowances; if we lower one, we will say so in the app before it takes effect.

6. Our guarantee

If you complete the requirements the app shows you, take the examination, and do not pass, send us proof of your result and we will extend your access free of charge for 90 days. Specifically:

• You must have completed two mock exams at 70% or better, and answered at least 80% of the question bank, before you sat the exam.
• That work must have been done on a paid subscription. Study completed during a free trial does not count towards the guarantee.
• The app shows you the date you completed these, taken from your own study history.
• You must claim within 180 days of that date.
• You must send a copy of your result showing your name, the result and the date you sat it. A photograph or screenshot is fine.
• The extension runs for 90 days from the date we grant it.
• One extension per person.
• We extend your access. We do not send money, because we cannot refund a store purchase.
• Each claim is reviewed by a person. Claims we believe to be fraudulent will be refused.

If you pass, tell us in the app and we will stop reminding you to study and take you straight to canceling.

7. Your account and conduct

You are responsible for what happens under your account. Do not copy, scrape, republish or resell our questions, explanations or any other content. Do not attempt to circumvent payment or access controls.

8. Our content

All questions, explanations and other material in Vexam belong to us or are used with permission, and are licensed to you for your own personal study only.

9. Availability

We aim to keep Vexam working but we do not promise uninterrupted service. We may change, suspend or discontinue features. If we withdraw a paid feature during a subscription period we will tell you.

10. Liability

To the extent the law allows, our total liability to you is limited to the amount you paid us in the twelve months before the claim. We are not liable for indirect or consequential loss, including examination outcomes.
